Planned Parenthood Casey Opinion

Abortion cases?

What was the DISSENTING opinion in Planned Parenthood v. Casey? Please tell me the dissenting opinion only.

This case, decided in 1992, essentially dealt with 5 issues of law in Pennsylvania concerning the regulation of abortion procedures in the state. The issues were :

1. All clinics providing services to women who wished to terminate their pregnancies had to inform potential users of the dangers of the procedure, or the 'informed consent' law.

2. Women had to give prior notice to their husbands before proceeding with the termination of the pregnancy.

3. Minors had to inform parents of their wish to terminate before proceeding.

4. There had to be a 24-hour period before the operation took place.

5. Pennsylvania required that certain information be provided by the clinics offering services to terminate a pregnancy.

The outcome of Planned Parenthood vs. Casey was complicated. While there was a plurality, none of the justices opinions was joined by a majority of justices.

William Rehnquist, Byron White, Harry Blackmun, John Paul Stevens, Antonin Scalia, and Clarence Thomas, the dissenters, wrote or joined opinions in which they partially concurred and partially dissented from the opinion.

The dissenters did not advocate the repeal of Roe v. Wade, and it was their opinion that the laws of Pennsylvania did not invalidate Roe v. Wade.

Renquist, Scalia and Thomas enjoined the plurality by upholding the waiting period, informed consent and parental disclosure laws. They dissented from the spouse notification law, stating that Roe v. Wade was incorrectly decided to begin with.

Blackmun and Stevens wrote decisions upholding the preservation of Roe v. Wade, and the striking of the spousal notification law. They however sharply dissented against the upholding of the other three laws, criticizing the anti-Roe justices.
